AI Acceptable Use Addendum
TradesKit — Field Service Management Software
This AI Acceptable Use Addendum ("AI Addendum") supplements the Terms of Service between you and Cascade Software Solutions LLC ("Company," "we," "us," or "our") for the TradesKit field service management service (the "Service"). It governs your use of features in the Service that use artificial intelligence, machine learning, large language models, or similar technologies (collectively, "AI Features").
This AI Addendum encodes a foundational design constraint of the Service: AI outputs are advisory. A licensed contractor or other appropriately authorized human is always the actor of record on every regulated decision, regulatory submission, and customer-facing transaction. The Service is engineered around that constraint, and your use of it is conditioned on that constraint.
Please read this AI Addendum carefully before enabling or using AI Features.
1. Scope
This AI Addendum applies whenever you (or any Authorized User) interact with AI Features, including AI Features that:
- Generate text (summaries, descriptions, drafts of customer communications, suggested job notes);
- Analyze photos (equipment identification, condition assessment, deficiency detection);
- Transcribe audio (voice notes, call recordings);
- Recommend actions (suggested pricing, suggested scheduling, suggested next steps);
- Classify or tag records;
- Surface predictions, scores, or other inferred values; or
- Otherwise produce content or decisions based on inputs you or your business provides ("AI Output").
The Terms of Service, Privacy Policy, Data Processing Addendum, and Acceptable Use Policy apply in addition to this AI Addendum. In the event of conflict on the subject of AI Features, this AI Addendum controls.
2. The Five Foundational Principles
These principles are load-bearing. They apply across all AI Features, present and future.
2.1 AI Output is Advisory, Not Advice
Every AI Output produced by the Service is advisory and intended to assist a human decision-maker. It is not a recommendation by Cascade Software Solutions LLC or by any TradesKit employee. It is not legal, regulatory, tax, accounting, medical, engineering, or other professional advice.
You must review and verify every AI Output before relying on it. You are responsible for the accuracy and completeness of every action you take based on AI Output.
2.2 The Contractor is the Actor of Record
For every regulated decision, regulatory submission, customer-facing transaction, and other consequential action that involves AI Output, you (or the licensed contractor or other appropriately authorized human within your business) are the actor of record. The AI is a tool the contractor uses, not a decision-maker.
In particular: when AI Features assist with preparing a regulatory document (such as a compliance report, a permit application, an annual filing, or a state-required certification), the contractor signs and submits the document. AI does not sign anything. AI does not submit anything to a regulator, taxing authority, insurance carrier, manufacturer warranty registrar, or other third party on its own.
2.3 No AI-Output Warranty
AI Features and AI Output are provided "AS IS" and "AS AVAILABLE." We do not warrant that AI Output is accurate, complete, current, fit for any particular purpose, free from bias, free from error, or non-infringing. AI Output may reflect patterns in training data that do not match your particular business, jurisdiction, or end customer. AI Output may be factually wrong while sounding confident.
You are solely responsible for verifying AI Output before relying on it, including by:
- Confirming numerical calculations independently before relying on them for pricing, billing, payroll, tax, or compliance purposes;
- Confirming regulatory citations and code references against current published authority;
- Confirming equipment identifications, model numbers, serial numbers, and similar specifics against the physical equipment;
- Confirming customer-facing communications for accuracy, tone, and appropriateness before sending; and
- Applying licensed-contractor professional judgment to all assessments, diagnoses, recommendations, and proposals.
2.4 You Indemnify Us for Your Failure to Verify
If a third-party claim arises from your use of AI Output without the verification described in this AI Addendum — including a claim arising from a regulatory filing, customer communication, work-order document, invoice, or other surface to which you submitted or attached AI Output without independently confirming its accuracy — you will defend, indemnify, and hold us harmless as set out in Section 14 of the Terms of Service.
For clarity, this indemnification applies to claims from your end customers, from regulatory bodies, from manufacturers, from insurers, from licensing authorities, and from other third parties.
2.5 No AI Training Without Your Opt-In
We do not use Customer Data (including the inputs you submit to AI Features and the AI Output the Service generates for you) to train any AI model unless you affirmatively opt in. We do not authorize our third-party AI providers to use Customer Data for training their general-purpose models; our contracts with AI providers require that restriction.
If we offer you the option to opt in to training data use in the future (for example, to improve features specific to your trade), the opt-in will be granular, explicit, and revocable at any time. Opting in or out has no effect on your access to or pricing of the Service.
3. Your Responsibilities
In addition to the obligations in Section 2 and elsewhere in your Agreement, when you use AI Features you will:
3.1 Verify Before Relying
Review and verify every AI Output before using it in any decision, communication, transaction, or filing.
3.2 Apply Professional Judgment
Apply the professional judgment of a licensed contractor (or other appropriately credentialed human) to AI Output. The AI is not licensed to practice your trade.
3.3 Do Not Submit AI Output Unverified
Do not submit AI Output to regulators, taxing authorities, insurers, manufacturers, licensing boards, customers, or other third parties without verifying it. If you choose to submit a document that contains AI Output, you represent that you have verified it and are submitting it as the actor of record.
3.4 Disclose AI Use Where Required
Comply with all applicable laws and rules requiring disclosure of AI-generated or AI-assisted content (for example, certain state consumer-protection rules and certain professional-licensing rules). Do not represent AI Output as human-generated when it is not, where doing so would be misleading.
3.5 Do Not Input Sensitive Categories Inappropriately
Do not input the following categories of information into AI Features unless the specific AI Feature documentation explicitly supports them:
- Sensitive Personal Information as defined under applicable state privacy laws (such as Social Security numbers, financial account information not needed for the Service's payment-processing surface, biometric identifiers, precise geolocation outside Service operation, government IDs, and contents of communications);
- Information protected by professional confidentiality (such as attorney-client privileged communications);
- Children's personal information regulated by COPPA;
- Information about health conditions or treatment unless directly relevant to the work being performed and consented to by the data subject; and
- Trade secrets of third parties.
3.6 Comply with Prohibited-Use Restrictions
You must not use AI Features to:
- Generate content intended to harass, defame, threaten, or discriminate against any person;
- Generate content that infringes the intellectual property rights of any third party;
- Generate content that violates any applicable law;
- Generate content to deceive end customers about the identity of the speaker (for example, claiming a contractor inspection occurred when AI generated the report without a contractor in fact performing the inspection);
- Train, fine-tune, or develop competing AI models, foundation models, or machine-learning systems;
- Reverse engineer, probe, or attempt to discover the underlying models, prompts, or training data;
- Bypass content filters or safety features in the AI Features;
- Extract personal information from AI Output that was not previously known to you and use that information without lawful basis; or
- Make automated decisions producing legal effects or similarly significant effects on a data subject without adequate human review.
4. AI Providers and Sub-Processors
The Service uses one or more third-party AI providers to deliver AI Features. The current AI provider(s) are listed in the sub-processor list referenced in the Privacy Policy and the Data Processing Addendum (currently including, but not limited to, Anthropic).
We require AI providers to be bound by contractual restrictions that, at a minimum, prohibit use of Customer Data for training the provider's general-purpose models. We will update the sub-processor list and provide customer notice as described in the Data Processing Addendum.
5. AI Output Ownership
As between you and us:
- Your AI Inputs. You retain all rights you have in the inputs you submit to AI Features.
- AI Output you generate for your use. You own the AI Output the Service generates for you, to the extent we can grant ownership. Note that AI Output may incorporate or reflect content learned by the AI provider's models, and we make no representation that AI Output is original or non-infringing (see Section 6).
- Aggregated metrics. We may collect aggregated and de-identified metrics about AI Features usage (such as feature engagement, error rates, and quality signals) consistent with the Privacy Policy and the Data Processing Addendum.
6. AI Output and Third-Party IP
We do not represent or warrant that:
- AI Output does not incorporate or reflect third-party content;
- AI Output does not infringe third-party intellectual property rights; or
- AI Output will be unique to you.
Our indemnification obligation under Section 14.2 of the Terms of Service does not extend to third-party claims arising from AI Output. If you receive a claim that AI Output infringes a third party's rights, that claim is not a covered claim under our IP indemnification, and you are responsible for defending it (subject to your right to seek contribution from third-party AI providers under their own terms, if applicable).
7. Beta AI Features
Some AI Features may be offered as beta, preview, or early-access ("Beta AI Features"). Beta AI Features are provided as-is, may contain bugs or substantial errors, and may be discontinued at any time. Section 25 of the Terms of Service applies, and the as-is and no-warranty disclaimers in this AI Addendum apply with full force to Beta AI Features.
8. Disable and Opt-Out
You may disable AI Features (where the Service supports per-Account or per-feature disabling) at any time through the Service's settings. If a particular AI Feature does not currently support disabling, we will work in good faith on customer request to provide an equivalent control.
Disabling AI Features may limit the functionality of the Service.
9. Changes to This AI Addendum
We may modify this AI Addendum as the law, the underlying AI technology, and our AI provider relationships evolve. Section 19 of the Terms of Service governs the notice and effective-date mechanics for modifications.
This AI Addendum forms part of the Agreement and is effective on the same date as the Agreement.
